These Terms & Conditions (“Terms”) govern your access to and use of our website, educational services, digital platforms, communication facilities, learning resources, customer support channels, and related services offered by THE TRADING DUO.By accessing our website, registering for any service, submitting an enquiry, purchasing an educational service, communicating with us through WhatsApp, RCS, email, telephone, or other supported communication channels, or otherwise using our services, you acknowledge that you have read, understood, and agreed to these Terms.If you do not agree with these Terms, please do not use the relevant services or website.These Terms should be read together with our Privacy Policy and any specific terms, notices, service descriptions, enrolment terms, refund policies, or other policies communicated to you in connection with a particular service.THE TRADING DUO may update these Terms from time to time to reflect changes in our services, applicable law, technology, or third-party platform requirements.

Acceptance of TermsYour use of THE TRADING DUO services constitutes acceptance of these Terms.If you are accessing our services on behalf of another person, such as a parent, guardian, student, organization, or institution, you confirm that you are authorized to do so.Certain services may have additional terms communicated at the time of enrolment, purchase, registration, or participation. Where specific terms apply, those terms will form part of your agreement with THE TRADING DUO.If there is a conflict between these general Terms and specific written terms applicable to a particular service, the specific terms may apply to the extent of that conflict.

Unless expressly stated in writing, THE TRADING DUO does not guarantee a particular examination result, admission outcome, rank, employment outcome, academic score, or other personal result.Students and users remain responsible for their own participation, preparation, decisions, and use of educational material.
5. EligibilityYou must provide information that is accurate and reasonably complete when using our services.Where a service is intended for students who are minors, participation may require involvement, authorization, or consent from a parent or lawful guardian as applicable.THE TRADING DUO does not knowingly require children to provide personal information beyond what is reasonably necessary for an educational service and applicable legal requirements.We may refuse, suspend, or restrict access to a service where information provided is materially inaccurate, fraudulent, misleading, or where continued access would violate applicable law or these Terms.

Account RegistrationCertain services may require registration or creation of an account.You are responsible for maintaining the confidentiality of login credentials associated with your account and for notifying THE TRADING DUO if you reasonably believe your account has been compromised.You agree not to:create an account using false information;impersonate another person;share credentials in a manner that violates service rules;attempt unauthorized access to another user’s account;interfere with website or platform security; oruse an account for unlawful or fraudulent activity.THE TRADING DUO may suspend or terminate an account where reasonably necessary to protect users, our systems, our service providers, or our legal rights.
7. User ResponsibilitiesUsers agree to use THE TRADING DUO services responsibly and lawfully.You must not use our website, educational platforms, communication channels, or content to:violate applicable law;distribute malware or malicious code;conduct fraud or impersonation;harass or threaten another person;interfere with our technical systems;gain unauthorized access to accounts or information;reproduce or distribute copyrighted educational material without permission;submit knowingly false information;misuse communication services;send spam through our systems; orengage in activity that could reasonably damage the reputation, security, or operation of THE TRADING DUO.Where educational materials are supplied for personal learning, users may not commercially reproduce, resell, redistribute, publish, upload, or otherwise exploit those materials without written authorization.

Payment & Billing TermsWhere a service requires payment, applicable fees will be communicated before or at the time of purchase or enrolment.Unless otherwise expressly stated:fees must be paid using an authorized payment method;users must provide accurate billing information;applicable taxes or statutory charges may be payable;payment obligations remain subject to the applicable service-specific terms; anda payment confirmation does not necessarily constitute acceptance of an enrolment where additional eligibility or verification requirements apply.THE TRADING DUO may use third-party payment processors. Payment information may therefore be processed directly by the applicable payment provider under its own terms and privacy practices.Users should not provide payment-card passwords, PINs, OTPs, or other confidential authentication credentials to THE TRADING DUO through ordinary communication channels.
9. Subscription Renewal & TerminationWhere THE TRADING DUO offers a recurring subscription, membership, programme, or other automatically renewing service, the applicable renewal frequency and charges will be disclosed before the recurring arrangement begins, subject to the payment provider and applicable law.A user may request cancellation in accordance with the applicable cancellation terms.THE TRADING DUO may suspend or terminate services where:the user materially breaches these Terms;payment remains unpaid;fraudulent or unlawful activity is suspected;continued provision would violate applicable law;a third-party platform or communication provider suspends the required service; oroperational circumstances require discontinuation.Termination does not automatically eliminate obligations that accrued before termination, including lawful payment obligations, intellectual property restrictions, confidentiality obligations, or provisions intended to survive termination.Any refund will be governed by the applicable refund or cancellation terms communicated for the relevant service.
10. Use of WhatsApp Official API & RCSTHE TRADING DUO may use official or authorized business communication technologies, including WhatsApp Business/WhatsApp Business Platform and RCS for Business, where such channels are available and appropriate for our services.These channels may be used for legitimate educational and customer communication purposes, such as:enquiry responses;registration-related communication;class or appointment reminders;service notifications;customer support;educational updates;transactional messages;important account notices; andpromotional communications where permitted and where appropriate consent or another lawful basis exists.Use of WhatsApp and RCS remains subject to the applicable rules, policies, terms, technical limitations, and requirements of Meta, WhatsApp, Google, telecom operators, messaging providers, and other relevant service providers.THE TRADING DUO does not represent that a WhatsApp or RCS service will always be available, uninterrupted, or approved for every proposed use case.Business information used in communication profiles and verification processes must be accurate and kept reasonably current.
11. Message Delivery & Compliance PolicyTHE TRADING DUO aims to send communications only where there is an appropriate relationship, lawful purpose, user request, or applicable consent.Where promotional messaging requires prior consent, we will seek and maintain appropriate consent records as reasonably necessary.Users may request cessation of promotional communications through available unsubscribe or opt-out mechanisms.For RCS communications, THE TRADING DUO will respect applicable opt-out mechanisms, including STOP or equivalent mechanisms where supported and required.Message delivery can be affected by factors outside our control, including:mobile network availability;internet connectivity;device settings;carrier restrictions;spam filtering;platform policies;account quality or reputation;recipient settings;technical failures; andregulatory or geographical limitations.Accordingly, THE TRADING DUO does not guarantee delivery, read status, response time, or uninterrupted availability of every message.THE TRADING DUO will not intentionally use messaging services for deceptive, fraudulent, malicious, abusive, or prohibited communications.
12. Intellectual Property RightsUnless otherwise stated, educational materials, website content, logos, branding, text, graphics, course materials, designs, videos, documents, software, and other content made available by THE TRADING DUO are owned by, licensed to, or otherwise lawfully used by THE TRADING DUO.Nothing in these Terms transfers ownership of such intellectual property to a user.Subject to payment and compliance with applicable restrictions, THE TRADING DUO may grant users a limited, non-exclusive, non-transferable right to access educational materials for personal learning purposes.Users must not reproduce, distribute, publicly display, commercially exploit, sell, sublicense, modify, or republish protected content without appropriate authorization.
13. ConfidentialityWhere a user provides confidential information to THE TRADING DUO in connection with a service, we will take reasonable steps to protect that information from unauthorized disclosure, subject to applicable law and legitimate business requirements.Confidentiality does not apply to information that:is publicly available without breach;was already lawfully known;is independently developed;must be disclosed by law, court order, or lawful authority; oris reasonably required to be shared with an authorized service provider for providing the relevant service.

Disclaimer of WarrantiesTHE TRADING DUO provides educational services with reasonable care and in accordance with the service description communicated to users.However, to the extent permitted by applicable law, services and website content are provided without guarantees that they will always be uninterrupted, error-free, completely current, or suitable for every individual purpose.Educational performance varies between individuals. THE TRADING DUO does not guarantee specific marks, ranks, admissions, examination outcomes, employment, income, or other results unless an express written commitment states otherwise.Third-party platforms, including communication, hosting, payment, telecommunications, and technology providers, may experience independent interruptions or policy changes.
15. Limitation of LiabilityTo the maximum extent permitted by applicable law, THE TRADING DUO shall not be responsible for indirect, incidental, consequential, special, or unforeseeable losses arising from the use of a service, website, third-party platform, communication channel, or educational material.Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable Indian law.Where liability is legally capable of limitation, the extent of liability will be determined with regard to the nature of the service, applicable law, and the circumstances giving rise to the claim.
16. IndemnificationTo the extent permitted by applicable law, you agree to indemnify and hold harmless THE TRADING DUO, its proprietor, personnel, and authorized service providers against claims, losses, liabilities, costs, and reasonable expenses arising from your:material breach of these Terms;unlawful use of our services;infringement of third-party intellectual property;fraud or intentional misconduct;misuse of communication services; orviolation of applicable law.This provision does not require a user to indemnify THE TRADING DUO for losses caused by THE TRADING DUO’s own unlawful conduct to the extent such indemnification would be prohibited by law.
17. Governing Law (India)These Terms shall be governed by and interpreted in accordance with the laws applicable in India.Subject to applicable statutory rights and dispute-resolution requirements, courts having appropriate jurisdiction in Pune, Maharashtra, may have jurisdiction over disputes arising from these Terms or the services of THE TRADING DUO.Nothing in this section prevents a consumer or user from exercising a mandatory right available under applicable law before an appropriate authority, forum, or court.
18. Changes to TermsTHE TRADING DUO may update these Terms when reasonably necessary because of changes in our services, business operations, applicable law, technology, or third-party platform requirements.The updated version will be published on the relevant website or otherwise communicated where appropriate.Your continued use of the applicable services after the effective date of an updated version may constitute acceptance of the revised Terms to the extent permitted by law.
